SkillMeBaby Organizer Terms

Version
1.0
Effective from

1. General provisions

  1. These organizer terms ("Organizer Terms") govern keeping an organizer profile and publishing Activities on SkillMeBaby. They supplement the Terms of Service, which apply to anything not covered here.
  2. The provider is Bartosz Gertych, a sole trader operating as BARTOSZ GERTYCH, ul. Stoczkowska 7 lok. 10, 04-147 Warsaw, Poland, tax ID (NIP) 7011057177, REGON 520286755; contact: [email protected].
  3. An Organizer may be a natural person, a legal person or another organisational unit with an Account. An organizer profile is run by its members (the owner and invited editors); every member accepts the Organizer Terms.
  4. Accepting the Organizer Terms is required to create an organizer profile.

2. Organizer profile

  1. Organizers create their profile in Studio. A new profile is not public until the Organizer submits it for review and the Provider approves it.
  2. The Provider reviews profiles for compliance with the law and the Terms. It may refuse approval, giving reasons. The Organizer can correct the profile and submit it again.
  3. The Organizer may hide the profile or withdraw it from review at any time.

3. Publishing Activities

  1. Organizers are responsible for Activity descriptions being true, complete and current, in particular dates, venue or online format, programme, required level, price (including all mandatory costs), number of places and how to sign up.
  2. An Organizer offering Activities to consumers as a trader is responsible for meeting the information and other obligations under consumer protection law, including the Polish Consumer Rights Act. The Organizer gives its identifying details in its profile.
  3. Publishing Activities that are unlawful, misleading, infringe third-party rights or contain content not allowed by the Terms of Service is forbidden.
  4. The Organizer grants the Provider a free, non-exclusive licence to display profile and Activity content (including logos and photos) on the Platform and in materials promoting the Platform, for as long as they are published. The Organizer confirms it holds the necessary rights to that content.
  5. Organizers may use the AI assistant in Studio. Its suggestions must be checked by the Organizer, who is responsible for the final content.

4. Sign-ups, delivery and cancellation of Activities

  1. In its current version SkillMeBaby does not take bookings or payments. Sign-ups, payments, cancellations and refunds happen directly between the participant and the Organizer, on the Organizer's terms, which the Organizer makes available to participants before the contract is concluded.
  2. Organizers deliver Activities as described. If an Activity is cancelled or changes materially, the Organizer promptly updates its description in Studio and informs registered participants directly.
  3. Organizers handle participants' complaints about Activities themselves.

5. Fees and settlements

  1. Using Studio and publishing Activities is currently free of charge. The Provider charges Organizers no fees or commissions.
  2. Fees, bookings or payments through the Platform will only be introduced by amending these Organizer Terms, with the notice period set out in section 8.

6. Ranking

The main ranking parameters are described in section 8 of the Terms of Service: Activities are listed from the soonest date by default (or by price if the User chooses), and the organizer list by the number of upcoming Activities. Organizers cannot pay to influence their position.

7. Restriction, suspension and termination

  1. The Provider may hide an Activity or profile, or suspend or terminate services to an Organizer, if the law or the Terms are breached. It gives a statement of reasons on a durable medium (by e-mail) before, or at the latest when, the decision takes effect.
  2. Terminating all services to an Organizer (except where required by law or for repeated infringements) takes effect with at least 30 days' notice.
  3. Organizers may delete their Activities and profile at any time.

8. Changes to the Organizer Terms

We notify Organizers by e-mail of proposed changes to the Organizer Terms at least 15 days before they take effect (in line with Regulation (EU) 2019/1150), unless a shorter period is required by law or the change is needed to address an unforeseen security threat. An Organizer who does not accept the changes may stop using Studio before they take effect. When a change requires acceptance, we will ask for it when you open Studio.

9. Complaints and mediation

  1. Organizers may complain about the Platform, review decisions or restrictions at [email protected]. We handle complaints within 14 days.
  2. The Provider is a micro-enterprise, so under Art. 12(7) of Regulation (EU) 2019/1150 it does not designate mediators. This does not rule out settling a dispute amicably, including through mediation, if both parties agree.

10. Participants' personal data

When an Organizer processes participants' personal data (e.g. for sign-ups), it does so as a separate controller and is solely responsible for GDPR compliance.

11. Final provisions

These Organizer Terms are governed by Polish law. Disputes with Organizers acting as traders are settled by the court competent for the Provider's registered office, unless mandatory law provides otherwise.
