1. General provisions

  1. These terms ("Terms") govern the use of the SkillMeBaby online platform available at skillmebaby.com ("Platform").
  2. The Platform is provided and operated by Bartosz Gertych, a sole trader operating as BARTOSZ GERTYCH, with a permanent place of business at ul. Stoczkowska 7 lok. 10, 04-147 Warsaw, Poland, entered in the Polish Central Register and Information on Economic Activity (CEIDG), tax ID (NIP) 7011057177, REGON 520286755 ("Provider", "we").
  3. Contact: e-mail [email protected], postal address: ul. Stoczkowska 7 lok. 10, 04-147 Warsaw, Poland.
  4. These Terms are the terms of electronically supplied services within the meaning of the Polish Act of 18 July 2002 on providing services by electronic means. They are available free of charge on the Platform in a form that can be downloaded, stored and printed.
  5. How we process personal data is described in the Privacy Policy, and how we use cookies in the Cookie Policy.
  6. Organizers who publish activities are also bound by the Organizer Terms.

2. Definitions

  • User — anyone using the Platform, including without an Account.
  • Account — a User's individual account on the Platform, protected by a password or linked to Google or Apple sign-in.
  • Organizer — a User who created an organizer profile in Studio (alone or as a member of an organizer's team) and publishes Activities on the Platform.
  • Activity — a description of a class, workshop, course, event or another way of learning a skill, published by an Organizer or the Provider.
  • Studio — the part of the Platform where Organizers manage their profile and Activities.
  • Consumer — a natural person entering into a legal transaction with the Provider that is not directly related to their business or profession.

3. Services

  1. Through the Platform the Provider offers the following services free of charge:
    1. browsing and searching Activities and Organizer profiles, including by city, category and skill;
    2. keeping an Account and managing its settings;
    3. for Organizers — keeping an organizer profile and publishing Activities in Studio, under the Organizer Terms.
  2. The Platform is informational. In its current version SkillMeBaby does not take bookings, does not sell tickets or places and does not handle payments. Prices shown with Activities are informational and come from Organizers. A User enters into the contract to take part in an Activity directly with the Organizer, on the Organizer's terms. See the Booking and Cancellation Rules.
  3. The Provider is not a party to contracts between Users and Organizers and is not responsible for their performance, subject to mandatory law.

4. Technical requirements

  1. Using the Platform requires a device with internet access, an up-to-date web browser with JavaScript and cookies enabled and, to create an Account, an active e-mail address.
  2. A particular risk of electronically supplied services is malware or unauthorised access by third parties. We recommend keeping software up to date and never sharing sign-in details.

5. Account

  1. Creating an Account is voluntary and free. It requires an e-mail address confirmed with a one-time code, a first name or display name and a password, or signing in with Google or Apple, as well as accepting these Terms.
  2. Accounts may be created by persons aged at least 16. Minors may use the Platform only with the consent of their legal guardian.
  3. The contract for keeping an Account is concluded when the Account is created, for an indefinite period.
  4. Users must provide true and current data and protect their sign-in details from third parties.
  5. Users may change their Account details at any time, sign out of all devices and close their Account by requesting deletion at [email protected]. We delete the Account without undue delay and no later than 30 days after receiving the request. Closing the Account terminates the contract for keeping it.

6. Rules of use

  1. Users use the Platform in accordance with the law, these Terms and good practice.
  2. In particular, it is forbidden to: provide unlawful content, including content infringing personal rights or intellectual property; impersonate others; disrupt the Platform, including by automated data collection that burdens its infrastructure; use the Platform to send unsolicited commercial communications.
  3. The Provider may temporarily limit access to the Platform for maintenance, keeping interruptions to a minimum.

7. Content and notices of illegal content

  1. Organizers are responsible for the organizer profiles and Activities they provide. Organizer profiles become public only after the Provider approves them; approval does not guarantee the quality or accuracy of all information.
  2. Anyone can report content they consider illegal or contrary to these Terms at [email protected] (subject: "Content notice"). A notice should include: an explanation of why the content is illegal or not allowed, the exact address (URL) of the content, the name and e-mail address of the person reporting (except for notices concerning offences against children) and a statement of good faith.
  3. The Provider handles notices promptly, diligently and objectively and informs the reporting person of its decision. When content is removed or an Account restricted, the Provider gives the affected person a statement of reasons and information on how to contest the decision, in accordance with Regulation (EU) 2022/2065 (Digital Services Act).
  4. Single point of contact for Member State authorities, the European Commission and Users: [email protected]. Polish and English may be used.

8. Ranking of Activities

  1. By default, Activities are listed from the soonest date. Users can sort them by price instead. Which Activities appear depends on the filters chosen (city or location, category, skill, date, search phrase). Organizers in the organizer list are ordered by their number of upcoming Activities, then alphabetically.
  2. Organizers cannot pay for a higher position. If promoted content is introduced in the future, it will be clearly labelled.

9. Complaints about the Platform

  1. Complaints about how the Platform works can be sent to [email protected] or by post to the Provider's postal address (ul. Stoczkowska 7 lok. 10, 04-147 Warsaw, Poland). Please include your contact details and a description of the problem.
  2. The Provider handles complaints within 14 days of receipt and replies to the e-mail or postal address given.
  3. Complaints about Activities (e.g. how they were run, cancellations, payments) should be addressed to the Organizer.

10. Liability

  1. The Provider strives to keep the Platform working properly but does not guarantee uninterrupted availability.
  2. The Provider is not responsible for content provided by Organizers or for the performance of contracts between Users and Organizers, unless mandatory law provides otherwise. Towards Consumers, limitations of liability apply only to the extent permitted by law.

11. Consumer rights

  1. A Consumer who concluded the contract for keeping an Account may withdraw from it without giving reasons within 14 days of its conclusion by sending a statement to [email protected]. Deleting the Account is also sufficient. The Platform's services are free, so withdrawal involves no costs.
  2. Consumers may use out-of-court complaint and redress procedures, including the help of municipal or district consumer ombudsmen and the regional Trade Inspection offices. Information is available on the website of the Office of Competition and Consumer Protection (uokik.gov.pl).
  3. The provisions on Consumers also apply to a natural person entering into a contract directly related to their business when the contract shows that it is not of a professional nature for them.

12. Changes to these Terms

  1. The Provider may change these Terms for important reasons, in particular changes in the law, in the scope of services or for security reasons.
  2. We announce changes on the Platform and by e-mail to Account holders at least 14 days before they take effect, unless the law requires a shorter period.
  3. When a change requires acceptance, Users will be asked to accept it when they sign in. Users who do not accept the changes may delete their Account before they take effect.
  4. Each published version of these Terms has a number and an effective date; previous versions remain available on the Platform.

13. Final provisions

  1. These Terms are governed by Polish law. This choice of law does not deprive Consumers of the protection granted by mandatory provisions of the law of the country of their habitual residence.
  2. Disputes with Consumers are settled by the courts having jurisdiction under general rules.
